Do we have to fully disclose all our finances to each other in a property settlement?
Yes. Both parties are legally required to give full and frank disclosure of their financial situation, which means all assets, debts, income, and superannuation. While it can feel uncomfortable, being transparent is the only way to ensure a fair and binding agreement. If something is hidden and later discovered, the whole settlement can be reopened. We’ll guide you through the process so it feels less daunting and make sure your interests are protected.
If one partner contributed more (or owned property before the relationship), do they get a larger share?
Possibly — but it’s not the only factor. The court (or your negotiated agreement) looks at both financial and non-financial contributions, such as caring for children or running the household. Every case is unique, and our role is to help you achieve a fair outcome that reflects the whole picture — not just one piece of it.
How are debts (mortgage, loans, credit cards) handled – who is responsible after separation?
Debts are treated just like assets: they’re part of the overall property pool. This means mortgages, loans, and credit cards are all considered, regardless of whose name they’re in. Often, debts are paid out of the asset pool before the remainder is divided, but arrangements can vary.
Who gets to stay in the family home after we separate? Can my ex (or I) make the other leave?
In many cases, one person will stay in the home while the other moves out, but legally both of you still have a right to live there until a property settlement or court order says otherwise. If there are safety concerns, urgent court orders can be made. If not, it usually comes down to practical arrangements and negotiation.
Are assets or money acquired after separation included in the settlement?
Yes. Anything acquired before your property settlement is finalised can be included. This means savings, property, or even debts taken on after separation may still form part of the pool. It is important to note that the assets and liabilities capable for distribution are those at the time of finalising your property settlement, not the date you separated.
How do we actually split superannuation – what’s the process to transfer part of my super to my ex?
Superannuation is treated as property and can be divided by agreement or court order. The process is called a superannuation split. It doesn’t mean you withdraw money; instead, a portion of your super is transferred into your ex’s fund (or vice versa). The super stays preserved until retirement, just like any other super balance.
We’re separated but not yet divorced – can we settle our property now, or do we have to wait until after the divorce?
You don’t have to wait. Property settlements can happen any time after separation — you don’t need to be divorced first. In fact, it’s usually best to deal with property sooner rather than later, so assets and debts don’t keep changing and complicating things.
Do I need a lawyer for this, or can we do the property settlement ourselves?
You can certainly try to reach an agreement yourselves, and many people start that way. But without a legally binding agreement (Consent Orders or a Binding Financial Agreement), your ex could make a claim against you years down the track. Having a lawyer ensures your settlement is final, enforceable, and fair. We’re here to make the process easier and less stressful — not more complicated.
