What is a Domestic Violence Order (DVO)?
A DVO is a court order designed to protect you, your children, or others from abuse, harassment, or threats. It places conditions on the other person’s behaviour to help keep you safe.
How long does a DVO last?
Typically, a DVO can last up to 5 years, but the court may set a shorter or longer period depending on the circumstances.
What if someone applies for a DVO against me?
You have the right to respond and present your side. Having legal advice is crucial because a DVO can affect your ability to see your children, live in your home, or hold certain jobs and licences.
Does a DVO mean I can’t see my children?
Not necessarily. Each case is unique, and parenting arrangements can still be made. However, the existence of a DVO may influence what the court believes is safe for children.
Is it possible to extend a DVO when the original order expires, and what is the process?
Yes, it’s possible. If you still have genuine concerns for your safety (or your children’s safety), you can apply to extend a Domestic Violence Order before it ends. You’ll usually need to show the court that the risk or behaviour that led to the original order is still present. This might involve providing updated evidence or outlining recent incidents that make you feel unsafe.
What should I do if police tell me reported incidents aren’t “serious” domestic violence and refuse to act?
This can be really frustrating and disheartening, but you still have options. Even if police decide not to take further action, you can make your own application directly to the Magistrates' Court for a Domestic Violence Order. The court will then assess your situation independently of the police’s view. It’s important not to give up if you feel unsafe — what may seem “minor” to authorities can still have a huge impact on your wellbeing. We can help you prepare and file the application so your voice is heard and your concerns are taken seriously.
What happens if the respondent (the person the DVO is against) breaches the order – will they be charged?
Yes. Breaching a Domestic Violence Order is a criminal offence in Queensland. If the respondent ignores or breaks any of the conditions of the order — for example, by contacting you when they’re not allowed to — you should report it to the police straight away. The police can charge the person, and if found guilty, they may face serious penalties such as fines or jail time.
