Is it 12 months of separation for to apply for a divorce, no matter the circumstances?
Yes. In Australia, the law requires that you and your spouse be separated for at least 12 months before you can apply for a divorce. This rule applies regardless of the circumstances of the marriage breakdown. The only exception is if you try to reconcile for a short time (up to 3 months) and it doesn’t work out — in that case, the periods of separation before and after can be added together.
How do I actually file for a divorce after a year of separation, and how do I serve the papers if I don’t know my spouse’s address?
You can apply for a divorce through the Federal Circuit and Family Court of Australia. If you can’t locate your spouse, you can apply for “substituted service” (serving the papers on someone close to them or by another method) or “dispensation of service” (asking the court to waive the service requirement). These applications can be tricky, so it’s best to get legal help to avoid delays or rejections.
How long after separation can we claim a financial settlement? Are we out of time?
You must apply for a property settlement within:
- 12 months of your divorce being finalised (for married couples), or
- 2 years of separation (for de facto couples).
If you’re outside this time limit, it’s still possible to apply with the court’s permission, but you’ll need to show good reasons for the delay and that hardship would be caused if the settlement isn’t allowed.
My ex has relocated interstate with our children, and our parenting plan isn’t working. What can I do?
If your ex has moved interstate and the current arrangements are no longer workable, you may need to apply to the court for parenting orders. The court’s focus is always on the best interests of the children, including stability, schooling, and maintaining a meaningful relationship with both parents where possible. If there’s concern about relocation, the court can make specific orders about where the children live and how time with each parent is arranged.
If my ex agrees I have full custody, do I need any legal document (e.g. consent orders) to manage child’s affairs (like passports)?
Yes. Even if you and your ex are on good terms, a verbal agreement isn’t legally binding. To protect yourself and avoid issues later (like applying for a passport, changing schools, or medical decisions), you should formalise the agreement with either:
- Consent Orders (approved by the court), or
- A Parenting Plan (less formal, but not legally enforceable).
Consent Orders are stronger because they are legally binding and enforceable if disputes arise.
What is spousal maintenance, and who can claim it?
Spousal maintenance is financial support that one partner may be required to pay the other after separation or divorce. It applies if one person is unable to adequately support themselves and the other has the capacity to pay. Common situations include where one partner has been out of the workforce caring for children, has health issues, or there’s a significant difference in income and financial resources. Maintenance can be short-term (to help someone get back on their feet) or longer-term in certain circumstances.
